1. Introduction & Acknowledgment of Risks
Cometa Ventures S.L. (“Cometa Living”) provides accommodations and facilitates outdoor activities for its members. While we strive to create a safe and enjoyable environment, participation in these activities and shared accommodations involves inherent risks, including but not limited to:

• Inclement weather conditions

• Equipment failure or malfunction

• Inadequate safety measures or supervision

• Collisions or interactions with other participants, vehicles, or natural objects

• Encounters with wildlife or natural hazards

• Physical exertion, trauma, or injury from adventure sports (e.g., kitesurfing, surfing, skiing)

• Foodborne illnesses or allergic reactions

• Emotional and psychological stress

• Exposure to communicable diseases due to close proximity with other guests

• Theft, loss, or damage to personal property

I understand that Cometa Living does not own or operate the activities provided by third-party instructors, guides, or service providers. Any participation in such activities is at my sole discretion and risk.
 
2. Assumption of Risk
By agreeing to this waiver, I willingly assume full responsibility for all risks, both known and unknown, associated with my participation in these activities and my stay at Cometa Living properties. I acknowledge that:

• Engaging in outdoor sports and shared accommodations may test my physical and mental limits.

• There is a risk of death, serious injury, property loss, or emotional trauma.

• Cometa Living is not responsible for the actions, negligence, or behavior of other guests, activity providers, or third-party service providers.

3. Waiver and Release of Liability
In consideration of the opportunity to participate in activities and stay at Cometa Living properties, I hereby:

• Release, waive, discharge, and covenant not to sue Cometa Living, its directors, officers, employees, agents, affiliates, and any third-party service providers from any and all liabilities, claims, demands, actions, or causes of action related to injury, death, property loss, or damages arising from my participation, whether caused by negligence or otherwise, except in cases of gross negligence or willful misconduct.

• Accept full responsibility for my own safety and well-being, including my physical health, medical condition, and personal property.

• Acknowledge that Cometa Living is not responsible for the behavior of other guests or the quality/safety of third-party services.

 
4. Indemnity Agreement
I agree to indemnify and hold harmless Cometa Living from any:

• Claims, liabilities, damages, costs, or expenses (including attorney fees) arising from my participation in activities or my stay at Cometa Living properties.

• Injuries or damages to others caused by my actions, whether intentional or accidental.

 
5. Medical Acknowledgment, Insurance, and Release

• I affirm that I am in good health and physically capable of engaging in outdoor sports and staying in shared accommodations.

• I understand that Cometa Living does not provide travel, health, or accident insurance. It is my sole responsibility to obtain adequate insurance coverage for:

  • Medical expenses, injuries, or emergency treatments

  • Property loss or theft

  • Trip cancellations, delays, or interruptions

  • Accidents or injuries during outdoor activities

• I authorize Cometa Living to seek emergency medical treatment on my behalf if necessary, assuming full responsibility for all associated costs.

6. Governing Law & Jurisdiction

• This waiver shall be governed by and construed in accordance with the laws of Spain.

• Any disputes, claims, or legal actions arising from this waiver shall be resolved exclusively in the courts of Spain.

7. Acknowledgment of Understanding & Digital Agreement
 
By checking the box, I acknowledge that:

• I have read, understood, and voluntarily agree to this waiver.

• I understand that I am giving up substantial legal rights, including my right to sue.

•  I confirm that I am at least 18 years old, or if under 18, my parent/legal guardian has reviewed and agreed to these terms on my behalf.

•  This agreement is binding upon myself, my heirs, next of kin, executors, administrators, assigns, and representatives in the event of my death or incapacity.
